What must exempt work still do?

Exempt work has to use best management practices to keep sediment from leaving the site (8.7.101(C)). Utility providers have their own rule: major regional installations follow the article, and other utility-provider work is exempt but uses best management practices (8.7.101(D)).

What is the 25-foot shoreline management area?

Section 8.7.111 establishes a shoreline management area of 25 feet in slope distance landward of the ordinary high water mark of all recognized lakes, the Coeur d'Alene River and the Spokane River. Mechanical ground disturbance is generally not allowed there except for listed uses, such as one stairway or walkway with landings and a tram per parcel (more where shoreline frontage passes 250 feet), with walkways limited to 4 feet wide and landings to 6 feet. Separate stream protection buffers, 75 feet for Class 1 streams, 30 feet for Class 2 and 5 feet at drainage swales (no more than 30 feet total), apply to streams but not to lake and river shorelines.

When does the state stormwater permit apply?

Idaho DEQ says owners and operators of projects that disturb one or more acres, or are part of a common plan of development that does, and that discharge stormwater, must get coverage under the construction general permit. The county article is separate; meeting one does not satisfy the other.

When does the Idaho Department of Lands apply?

Before building an encroachment on a navigable lake, such as a dock, marina or shoreline stabilization, an encroachment permit from the Idaho Department of Lands is required under the Lake Protection Act. The department says its encroachment rules (IDAPA 20.03.04) were approved by the 2026 Idaho Legislature and took effect July 1, 2026.

Who issues permits inside a city?

Inside a city, start with the city's building or planning office. The county's Building Division of Community Development issues building permits for dwellings, garages, pole barns, decks and similar structures outside cities, and its page asks anyone unsure of the permit type to check with the office first.

What happens before digging?

Idaho Code 55-2205 has an excavator pre-mark the path in white paint, unless a locate ticket or an on-site meeting with the facility owner covers it, and give notice through the one-number notification service between two and ten business days before the planned start. Contractors register with the Idaho Contractors Board at DOPL; Idaho Code 54-5203 counts excavating as construction.
